Terms of Service

By downloading or using the Faces app or website ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Skinphics LLC, the operator of Faces ("Faces," "we," "us," or "our").

You must be at least 13 years old to use Faces. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at team@faces.skin if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.

Faces provides personalized skincare information and AI-generated recommendations for informational and wellness purposes only. The Service is not a medical device and does not provide medical diagnosis, treatment, or advice. Nothing in the Service should be construed as medical advice or a substitute for consultation with a qualified healthcare professional. Always consult a dermatologist or physician for skin conditions that concern you.

You retain ownership of photos and data you upload ("Your Content"). By submitting Your Content, you grant Faces a limited, non-exclusive license to store, process, analyze, and — where you choose to post publicly, such as product reviews and comments — display it to other members, in each case solely to provide the Service. We do not sell Your Content. You may delete Your Content at any time by deleting your account.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service.
• Upload content that is obscene, harassing, or infringes third-party rights.
• Interfere with the security or integrity of the Service.
• Create accounts on behalf of others without their consent.

Faces has zero tolerance for objectionable content and abusive behaviour. Reviews, comments, photos, and profile content that are obscene, hateful, harassing, threatening, or that infringe the rights of others are not permitted.

You can report any content or member from within the app. We review every report and will remove violating content and eject the member responsible within 24 hours. You can also block any member at any time from their profile; blocking hides their content from you and yours from them.

We may remove content and suspend or terminate accounts at our discretion for violations of this section.

All software, designs, AI models, and content provided by Faces are owned by or licensed to us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

The Service is built on third-party providers, including Anthropic and OpenAI for AI processing (see our Privacy Policy), Supabase for data storage, and Apple for app distribution. Your use of those services is governed by their own terms. We are not responsible for third-party services.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI recommendations will be accurate or suitable for your skin.

To the maximum extent permitted by law, Faces and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

You agree to indemnify and hold harmless Faces and its affiliates from any claims, losses, or damages arising from your violation of these Terms or misuse of the Service.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account at any time via Settings in the app. Upon termination, your right to use the Service ceases immediately.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

We may update these Terms. We will notify you by email or in-app notice before material changes take effect. Continued use after the effective date constitutes acceptance.
